Circular No. 04/2023/TT-BTTTT provides for the List of potentially unsafe products and goods under the management responsibilities of the Ministry of Information and Communication

On May 31, 2023, the Ministry of Information and Communication issued Circular No. 04/2023/TT-BTTTT to regulate the List of products and goods causing loss of safety as the responsibility of the Ministry of Information and Communication. This Decision shall take effect from July 15, 2023 and replace Circular 02/2022/TT-BTTTT.


At the request of the Director of the Department of Science and Technology, the Minister of Education and Technology issued a Circular on May 16, 2022, stating that the list of products and goods that are likely to cause insecurity is the responsibility of the Ministry of Science and Technology, replacing Circular No. 02/2022/TT-BTTT issued on May 16.

Some amendments and additions to Circular 02:

• Update version some new standards and new HS code: QCVN 18:2022/BTTT, QCVN 130:2022/BTTT, QCVN 131:2022/BTTTT, QCVN 132:2022/BTTTTT.

• Change the electrical safety standards applied to DECT phones from QCVN 22:2010/BTTTT & QCVN 22:2021/BTTTT to apply QCVN 132:2022/BTTTT.

• Ground mobile information terminals imported or manufactured in Vietnam for the first time after July 1, 2024 are required to integrate 4G LTE technology.

• Regulatory certificates for terrestrial mobile communication terminals that do not integrate LTE technology (issued before July 15, 2023) will automatically expire on June 30, 2024.

• 5G NR mobile communication terminals imported or manufactured in Vietnam for the first time after July 15, 2023 are required to support both 5GSA and 5G NSA hybrid modes.

Since domestic test labs are not yet qualified to test QCVN 127:2021/BTTT and QCVN 129:2021/BTTT for 5G NR phones and terminals, It is expected that the Ministry of TT&TT will continue to allow the use of test results of domestic and foreign testing laboratories with ISO/IEC 17025 certification for the purposes of validation (full testing of ETSI indicators, including exemptions under CE RED regulations).

• Mandatory supplement QCVN 132:2022/BTTTT for target devices such as DECT (Subscriber-Type IP Phone), PC, Laptop, Tablet PC, IPTV Setup Box, Television... Effective July 15, 2023. Conditions apply from January 1, 2024, for testing before January 1, 2024, IEC 62368-1:2018.

• For other products such as Laptop, Desk PC, TV, Notebook, Set-top-box... QCVN 132:2022/BTTTT is confirmed to be in accordance with DoC, therefore, the application of QCVN 132:2022/BTTTT does not affect the regulation certificates issued before July 15, 2023.

• Short-range radio equipment, including NFC, operates in the 13.553-13.567 MHz bands, which are switched from Annex 1 (requires certification of conformity and disclosure of Annex 2).

• The Ministry of ICT (temporary) accepts the test results of domestic and foreign test organizations recognized to conform to ISO/IEC 17025 standards in accordance with the corresponding technical requirements in IEC 62368-1:2018 to assess conformity with Regulation No. 132:2022/BTTTTT. Accordingly, the individual organization that recommends a registration certificate (manufacturer, importer) must submit a test room certificate that meets the applicable ISO/IEC 17025 standards along with the file set for the Registration Certificate and/or the Regulatory Publication.

• QCVN 117:2023/BTTTT and QCVN 55:2023/BTTTT will be incorporated and included in the Circular on the list of goods in Group 2 between 2024 and 2025, applied from 01 July 2024.
